Terms of Service

Terms for using QuackPath.

1. Acceptance of these Terms

These Terms of Service ("Terms") form a binding agreement between you and QuackPath. By creating an account, downloading, or using the QuackPath app or any related services (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country to consent to online services) and legally able to enter into a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

  • You may sign in using Google, Apple, or email and password.
  • You are responsible for keeping your sign-in credentials secure and for activity that occurs under your account.
  • You agree to provide accurate information when prompted and to keep it up to date.
  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.

4. License to use the app

Subject to these Terms, QuackPath grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Service for your own personal, non-commercial language learning. All rights not expressly granted are reserved.

5. Acceptable use

  • Do not use the Service in a way that violates any law or the rights of others.
  • Do not harass, abuse, threaten, bully, stalk, impersonate, or otherwise engage in harmful conduct toward other users, including through display names, profiles, messages, challenges, or any other social or interactive feature.
  • Do not upload, paste, scan, photograph, dictate, share, or otherwise import content you do not own or do not have the right to use for your own personal study.
  • Do not submit content that contains another person's private or personal information without their permission.
  • Do not attempt to reverse engineer, decompile, scrape, probe, overload, or interfere with the Service or its infrastructure.
  • Do not bypass usage limits, authentication, rate limiting, or any access controls.
  • Do not use the Service to generate or distribute infringing, hateful, harassing, sexual, deceptive, or otherwise unlawful material.
  • Do not use voice features to record anyone other than yourself without their consent.

6. User Content and your responsibility for it

QuackPath lets you create study material from content you provide ("User Content"). User Content includes text you type or paste, text recognized from photos and document scans, text and files you share into QuackPath from other apps, situation descriptions you type or dictate, and your voice when you speak to the AI tutor or practice pronunciation.

You are solely responsible for your User Content. Each time you add content, you confirm — as the in-app checkbox states — that you can use that content for personal study. By submitting User Content you represent and warrant that you own it or otherwise have all rights, permissions, or licenses needed to use it with the Service. This applies equally to song lyrics, books, articles, photographed or scanned pages, and any other material protected by copyright or other rights. QuackPath does not review, license, or clear rights in your User Content for you, and nothing in the Service should be understood as permission to use someone else's content.

Private, personal study only. Study material generated from your User Content is created for your own account and your own personal learning. We do not publish it, share it with other users, or redistribute it beyond what is needed to provide the Service to you, and you agree not to redistribute it yourself or use it to republish the underlying content.

You retain ownership of your User Content. You grant QuackPath a worldwide, royalty-free license to host, store, transmit, process (including with the AI providers described in the Privacy Policy), transform, and display your User Content solely as needed to operate, secure, and improve the Service for you. We may remove or disable access to any User Content or generated material that we believe infringes someone else's rights or violates these Terms, and we may suspend or terminate the accounts of repeat infringers.

7. Copyright complaints

We respect the rights of content owners. If you believe material stored through the Service infringes your copyright, send a notice to support@quackpath.com with the subject "Copyright complaint" that includes: (a) a description of the copyrighted work you believe is infringed; (b) enough information for us to locate the material (for example the account, course title, or content excerpt); (c) your contact details; (d) a statement that you have a good faith belief the use is not authorized by the rights owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorized to act for them; and (f) your physical or electronic signature.

On receiving a valid notice we will remove or disable access to the identified material and notify the user who submitted it. That user may respond with a counter-notice containing their contact details, identification of the removed material, and a statement under penalty of perjury that they have a good faith belief the material was removed by mistake or misidentification; where appropriate we may restore material in response to a valid counter-notice. We terminate the accounts of repeat infringers.

8. AI-generated content

Courses, translations, example sentences, hints, quiz questions, tutor replies, and synthesized speech are generated by automated AI systems. AI output can be incomplete, inaccurate, mistranslated, or misleading, and may not reflect the views of QuackPath. Verify anything important before relying on it. AI output is provided for language practice only and is not professional, medical, legal, financial, or educational-certification advice. Your inputs are processed by the third-party AI providers described in the Privacy Policy in order to generate this output.

9. Third-party services

  • The Service relies on third-party providers, including Google Firebase (authentication, notifications), Apple platform services (sign-in, purchases, on-device text recognition and speech recognition), AI providers (such as Google, Groq, OpenAI, and Inworld), and Cloudflare (hosting, delivery, and backups).
  • Third-party services have their own terms and privacy policies, which govern your use of those services.
  • Availability of any third-party-dependent feature may change, be limited, or be discontinued without notice.

10. Intellectual property

The QuackPath name, logo, app, generated study scaffolding, user interface, and underlying software are owned by QuackPath and protected by intellectual property laws. These Terms do not transfer any ownership of QuackPath's intellectual property to you, and you may not copy, modify, distribute, sublicense, or create derivative works of the Service except as expressly permitted.

11. Subscriptions and billing

QuackPath offers an optional paid plan ("QuackPath Plus") that unlocks additional features, including the AI voice tutor. The current price and duration for each plan are shown inside the app before you purchase.

  • Apple billing. On iOS, QuackPath Plus is sold through Apple's in-app purchase system. Payment is charged to your Apple ID at confirmation of purchase.
  • Auto-renewal. Subscriptions automatically renew at the end of each billing period unless auto-renew is turned off at least 24 hours before the period ends. Your account is charged for renewal within 24 hours prior to the end of the current period.
  • Manage or cancel. You can manage and cancel your subscription in your Apple ID account settings after purchase. Deleting the QuackPath app does not cancel a subscription.
  • Free trials and offers. Where a free trial or introductory offer is available, any unused portion of the trial is forfeited when you start a paid subscription. Eligibility for trials is determined by Apple.
  • Refunds. Refunds are handled by Apple under its standard refund policies. Deleting your QuackPath account does not refund or cancel an active App Store subscription.

12. Account deletion

You can delete your QuackPath account from Settings -> My Data. Deletion removes your account and associated learning data from our active systems. It does not cancel a subscription that is billed by Apple — cancel that separately in your Apple ID settings.

13. Service changes and availability

QuackPath is under active development. We may add, change, limit, or remove features at any time, and the Service may be unavailable from time to time for maintenance or reasons beyond our control. Generated study material, translations, and other content may be incomplete, delayed, or imperfect.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. THIS INCLUDES AI-GENERATED COURSES, TRANSLATIONS, TRANSCRIPTS, AND TUTOR REPLIES. QUACKPATH IS A STUDY AID AND IS NOT A SUBSTITUTE FOR PROFESSIONAL EDUCATION, TRANSLATION, OR LEGAL ADVICE.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, QUACKPATH AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO QUACKPATH IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

16. Indemnity

You agree to defend, indemnify, and hold harmless QuackPath and its developers from any claims, damages, liabilities, and costs (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your User Content — including any claim that User Content you submitted infringes the copyright or other rights of a third party.

17. Enforcement, suspension, and termination

At our sole discretion, and with or without prior notice, we may take any action we consider appropriate against your account or your User Content. This includes the right to restrict, suspend, limit, hide or make invisible to other users, or permanently terminate and delete your account and any associated content.

Grounds for such action include, without limitation: harassment, abuse, threats, bullying, or other harmful conduct toward other users; violation of these Terms or the acceptable use rules in Section 5 (including repeat infringement of others' rights); fraud, deception, or abuse of the Service; or any activity that may harm other users, the Service, or QuackPath. Where necessary to protect other users, the Service, or QuackPath, we may take such action immediately, which may include making the account or its content invisible to other users.

Termination of an account may result in the permanent deletion of the account and its data, consistent with Section 12 (Account deletion) and the Privacy Policy. Nothing in these Terms obligates us to monitor User Content or user conduct, and the rights described in this section are in addition to, and not in place of, any other rights or remedies available to us at law or under these Terms.

You may stop using the Service at any time and delete your account from inside the app. Sections that by their nature should survive termination (such as User Content licenses for residual copies, intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution) will survive.

18. Apple App Store terms

If you obtained the app through the Apple App Store, the following also applies. These Terms are between you and QuackPath only, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

19. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the QuackPath developer is established, without regard to its conflict-of-laws rules. To the extent allowed by your local law, any dispute arising out of or relating to these Terms or the Service will be brought in the courts located in that jurisdiction. Nothing in these Terms removes any mandatory consumer rights you may have under the law of your country of residence.

20. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated in the app or on this page. Your continued use of the Service after a change takes effect means you accept the updated Terms.
